However, does the contracting officer uses his discretion to address special situations FAR 13.106-1 (i) Contracting officers may solicit from one source if the contracting officer determines that the circumstances of the contract action deem only one source reasonably available (e.g., urgency, exclusive licensing agreements, brand-name or industrial mobilization)?

    You are correct.  FAR 13.104 states that the Contracting Officer MUST promote competion to the maximum extext practible ..........FAR 13.106-1(a) states you shall consider FAR 13.104 before FAR 13.106-1(a)(1) (i)-(iv).  Please document your file if you proceed other than FAR 13.104.
