The base Single Award Task Order IDIQ contract has expired. However, prior to its expiration, we exercised the last option period and now also need to use the properly included and evaluated 52.217-8 option. Prior to its expiration, the base IDIQ total contract ceiling wasn't increased in order to account for the 52.217-8 option...can we legally exercise that option now even though doing so would extend beyond the total ceiling at the time of expiration?

    Answer

The contracting officer may exercise options only after determining that funds are available along with the other conditions at Federal Acquisition Regulation (FAR) 17.207.  You should discuss this matter with your legal office and resource management office.
