I know govt received benefit from the work, but KTR did not follow protocol. I feel negotiating the cost for a benefit received would be the right thing to do but am I breaking any particular rules for doing so?
The contracting officer should brief the contractor about the need to notify the contacting officer's representative or the contracting officer directly about the need to perform additional work not specified in the contract, prior to starting that work. In this case, since the work provides a benefit to the Government and presumably is within the scope of the contract, the contracting officer can approve an invoice for this work. Of course the cost submission should be reviewed to ensure that it's fair and reasonable.
