Regardless of the fact that our funds are "non-expiring" we still have to follow the Bona Fide Need correct? We should not have awarded knowing that we had to wait for a different contract to be completed first, and that that different contract would not be completed for another year. There seems to be a violation here, am I mistaken?
Yes - you have to follow the Bona Fide Needs rule regardless of non expiring funds. There is no violation because you still needed the second contract. For example, your building a house - contractor A is building the foundation and frame. Contractor B is building the roof. You need both, so there is no violation.
