    How should you implement the anticipated weather delays once a contractor has exceeded the contract completion date? Appears that the anticipated weather days identified in the contract are for the contract period of execution regardless of the table specifying a full year of data. The question is it appears the contractor is due day for day delays after CCD unless we modify the contract when extending the contract through the changes clause and add appropriate anticipated weather days for the extension.


    Answer

    This is really not a problem. You issue a bi-lateral contract modification extending the completion date (at no additional cost) based upon an act of god, bad weather, preventing performance of the contract.  Please coordinate with your legal counsel and document your contract file.
