    A graduate tuition payment at $2,500 is to be paid for a employee. Is education exempt from the SCA? Is training exempt from the SCA?

    As the question is posed, this is not a contract, it is payment for something (education) that has already been agreed to.  This would not have been a formally competed contract action.  It is likely either a payment for a pre-selected institution determined by the employee or payment to an institution the government has already contracted to perform these services.
     
    Logically, the Service Labor Standards Act would not be applicable as the services provided are professional services and above the wages of the appropriate wage determination.
