    Is it permissible to use RFI's in a manner that leads to disqualifying potential offerors prior to issuing a solicitation? Specifically, using terms in an RFI which state that responding to the RFI is a pre-requisite for being determined eligible to respond to any future solicitation that might result.


    Answer

    The purpose of an RFI is to determine if there is capability in the marketplace for planning purposes.  There is nothing from which a potential offeror can be disqualified at this point.  You have not defined an award process from which an offeror could be disqualified.  Even if there were something from which an offeror could be disqualified, the idea flies in the face of competition.  If there is an offeror that your team believes should be disqualified, the processes to apply are found in FAR part 6.
