Can a buyer reduce the quantity of a buy to get under the TINA threshold in order to avoid obtaining Certified C&P data?
Answer
Yes, and no. If the quantity is reduced due to a reduced mission requirement, then an added benefit is not having to obtain certified cost or pricing data (CCPD). However, if the reduction is for the purpose of avoiding the requirement at FAR 15.403-4 to obtain CCPD, then "splitting" the Government's requirement is a de facto violation of the regulation and cannot be done.
