    If the work that is being bid is the same work can the contracting office re-negotiate a fixed fee?


    Answer

    Any work above and beyond the scope of the original contract, even if the type of work is identical to that performed in the basic contract, is subject to new terms and conditions as agreed to by the parties. The original terms and conditions apply to the scope of the original contract. "Follow-on work" is beyond that scope and subject to the terms and conditions of a modification.
