    If the procuring contracting activity withholds it (FAR 46.407(d) from DCMA, who is responsible for acceptance or rejection of use-as-is or repair dispositions? Could the procuring activity allow the contractor execute this function without government approval?


    Answer

    The answer is no. The contractor cannot execute this function. In accordance with FAR 46.407, only the PCO has the authority and responsibility to resolve matters of non-conformance unless delegated to the ACO in accordance with FAR 46.407(d).  Since there has been no delegation, the PCO is retains the authority.
