    During a deployment to Korea more than 5 years ago, a purchase was made for binders used in our aircraft to hold documents for easy access to the pilots. Not sure how the purchase was originally done; however, the binders need replacement. I helped one of the cardholders locate sources in the U.S.; however, the binders provided do not meet the specs or quality of the ones bought in Korea. Can the purchase be made from the Korean vendor if no sources can be found domestically? I reviewed 252.225-7001 Buy American and Balance of Payments Program, and this is a COTS. Any guidance would be greatly appreciated.

    While our DAU AAP response is advisory only, we agree with your conclusion that the proposed purchase from a Korean source would fall under the COTS provisions of DFARS 252.225-7001.  

    Finally, transaction and payment method for a minor procurement like this one using GPC is also determined by the purchasing organization, so we also agree that use of GPC (within the overall policy and procedures specified for GPC use) is also a reasonable course of action.
