    For A-E definitive contracts, which solicitation form do you use? SF33, SF1442, or both? If we can use the SF1442, in what scenarios do we use that form? Regardless of the solicitation form, we would like to use a SF252 for contract award.


    Answer

    The SF 1442 is used when sealed bidding is not appropriate to solicit offers and make awards for construction, alterations, or repairs. The SF33 is used to solicit for supplies or services and for awarding the contracts that result from sealed bids (FAR 53.214 (c)).  Unless the contract will be performed outside the United States and its outlying areas, the contracting officer shall use sealed bid procedures for a construction contract under the following conditions (FAR 6.401(a)):

               (1) Time permits the solicitation, submission, and evaluation of sealed bids;

               (2) The award will be made on the basis of price and other price-related factors;

               (3) It is not necessary to conduct discussions with the responding offerors about their bids; and

               (4) There is a reasonable expectation of receiving more than one sealed bid;
