    Is the EMD Phase of a ACAT III program normally considered a "Service"? If so, would SCA and Management and Oversight of Service Acquisition AR 70-13 be required/applied?

    The Engineering and Manufacturing Development (EMD) phase of the acquisition life cyle is most appropriately identified with product acquisition versus service acquisition. As such, the EMD phase is not considered a service. For purposes of AR 70-13, Management and Oversight of Service Acquisitions, the term “service” means the engagement of the time and effort of a contractor whose primary purpose is to perform an identifiable task, or tasks, rather than to furnish an end item of supply. Services embedded in supply or production contracts are subject to the provisions of AR 70-13. So, while the EMD phase is not considered a service, there may be services embedded in the EMD contract which would require management in accordance with AR 70-13.
