    Is it possible to issue a no cost task order? If not, my co-worker suggested doing an out of scope no cost modification to the FFP portion. Which is the best way to handle this situation?


    Answer

    There are contracts that have a Limit of Liability or Swing clause that provide thresholds if not breached, the work will be done at no cost. I would provide a no-cost bilateral task order to the contractor for accomplishment of the work. The task order should reference the contractor's zero cost proposal.
