If a class deviation expires before a contract's period of performance ends, is the authority permitted by the class deviation still effective until the contract ends (including option years)? When responding, please identify any regulatory or legal references, if possible.

    Answer

A review of the many class deviations on the DPAP website at http://www.acq.osd.mil/dpap/dars/class_deviations.html reveals that most of the guidance memos end with the following language  "This class deviation remains in effect until incorporated in the DFARS or is otherwise rescinded.  My point of contact for this action is .........  "  rather than an effective date.  At the time the class deviation is incorporated or rescinded, it should be accompanied by additonal guidance relative to effectivity.  If the guidance is not clear, it is best to contact the cited poc in order to more clearly understand the intent.
