    Can past contracts be modified to include clauses that were just approved in a class deviation?

    Typically the policy memorandum would explicitly state that current contracts may be modified to incorporate the changes (such a class deviation) covered by the memorandum. The memorandum may also state that the change(s) applies only to contracts with an effective date of ____ or later. In any case, if the memorandum does not explicitly state that the deviation can be applied to existing contracts, then most likely it cannot be.
