If over and above work is to be considered within the scope of the basic maintenance requirement IAW DFARS PGI 217.7701(5), is it justifiable to include the over and above work into the basic commercial contract (separate line items) even if not FFP?

    Answer

The intent of the DFARS coverage on over and above work requirements is to address them during contract performance rather than provide for them as a separate line item during contract award. The scope, nature, and pricing of the requirements are uncertain, so it would not be appropriate or meaningful to include a line item in the basic contract for over and above work. It could also be perceived as setting up an "expectation" that over and above work will be required.
